Few special education disputes see the inside of a courtroom, despite the widespread belief that this is a litigious process. At every step along the way, the opportunity for negotiation between families and school districts exists. The sooner in the process a satisfactory resolution to a dispute can be arrived at, the sooner a student will gain access to needed services. Congress, in amending the IDEA, encouraged the use of mediation for settling disputes. This session provides attorneys, advocates and parents effective strategies for "getting to yes" in Team meetings, mediation, resolution meetings and settlement discussions

Experts are a critical factor in special education cases, discrimination cases, Title IX cases, sexual assault cases and pretty much all cases. Courts and statutes say that Parents are entitled to have an equal footing at IEP’s and court proceedings when it comes to experts at hearing- that really isn’t panning out the way we hoped. Court’s routinely give deference to educators for more “face-time”. Choosing your expert early on can really make or break your ability to identify your child’s needs or convince a judge at a hearing and win!
